Introduction
In an effort to protect consumers from unwanted, spam or scam text messages, the FCC and TCPA (Telephone Consumer Protection Act) are requiring all SMS senders to collect express consent and to give the option to revoke consent. Failure to comply can result in a per-message federal fine.
With the assistance of legal counsel, Avionté has provided standard, compliant consent verbiage. Avionté’s consent functionality will prevent text messages from being sent to Talent who have opted out of messaging when initiating SMS via AviontéBOLD.
Key Takeaways
- You must collect express consent from your Talent and track those who have withheld consent to prevent unwanted text messaging.
- When using this feature, Avionté recommends that you collect texting consent from your Talent through the online application, Onboarding process, or Talent Portal. In addition to these preferred methods, you are also able to manually mark consent on your Talent's behalf, if needed
- The standard Avionté consent verbiage is intended to cover SMS sent natively through AviontéBOLD via our chosen 3rd party service provider. It does not apply to SMS sent through partner integrations or SMS sent outside of BOLD, such as through Sense, or any other 3rd party you may utilize for SMS.

Sending to Opt-Out Numbers
- If the user tries to send a text to a number that's revoked consent, an error message will display:
In this scenario, if a user attempts to text an individual Talent who is in an Opt-Out status, they will not be able to type or send an SMS message to them.
The functionality for blocking sending to opted-out numbers at this time only applies to BOLD's native SMS texting and not to third parties.
- If a user attempts to text en masse and there are Talent in that list who have Opted Out, that talent will be removed from the recipient list.
